Content of contract, conclusion of contract
After registration of the participant for the respective event, the participant will receive a written confirmation of registration. This confirmation constitutes the contract between Hafeneger Motorsport GmbH and the customer. The contractual services (type, scope) are bindingly defined in the service description of the offer for the booked event. Exclusive place of jurisdiction for legal disputes is Solingen.
Terms of payment, methods of payment
After his binding registration, the participant undertakes to pay the participation fee and any additional services booked in due time. HM reserves the right to withdraw from the contract and to cancel the booked event if payment is not made in due time.
SEPA Direct Debit:
With the issued SEPA Mandate the participant authorises HM to collect payments from his account. The participant will receive the final payment/nominal confirmation automatically after HM has debited the amount from his account. Debits of the entry fees by SEPA direct debit will be made approx. 6 weeks before the event.
For registrations that reach HM only 6 weeks or less before the event, the entry fees will be collected immediately. Should a direct debit be returned, HM is entitled to charge the participant the full amount of the resulting chargeback fee. The creditor identification number of HM is: DE40ZZZ00000170260. The mandate reference number of the participant is shown in the confirmation of registration and corresponds to the customer number. Note: The participant may request reimbursement of the amount debited within eight weeks of the debit date. The terms and conditions agreed with his bank apply.
The final payment/nomination confirmation will be sent to the participant after receipt of payment of the entry fee. Payment must be made at least 4 weeks before the event. For registrations that reach HM only 4 weeks or even less before the event, the amount must be paid immediately.
Cancellations up to 90 days before the event will incur a cancellation fee of 25 €.
Cancellations up to 30 days before the event will incur a cancellation fee of 50 €.
For cancellations up to 15 days before the event 50% of the entry fee will be refunded to the credit account
For cancellations less than 15 days before the start of the event there is no refund of the entry fee
Cancellations are only accepted in writing by e-mail to firstname.lastname@example.org.
If a replacement rider is found by the participant for the starting place, the participant must contact HM. In this case no cancellation fee will be charged.
If the booked event is fully booked and there is a waiting list, the participant will be charged a handling fee of 25,- € instead of the above mentioned cancellation conditions. However, this requires that a participant who is on the waiting list takes over the cancelled place.
Cancellation fees will be charged even if the event has not yet been paid.
A credit account is set up in the customer’s master data, which he can view at any time in his personal area (login area). The credit account is topped up from transferred vouchers and credits from cancellations, as well as from overpaid amounts for an event. The customer can determine for which of his booked events he would like to have the credit balance redeemed. The credit account is personal and non-transferable. Payment is not possible in principle, however, upon termination of the business relationship with Hafeneger Motorsport GmbH.
Participants take part in HM events at their own risk. They bear the sole civil and criminal responsibility for all damage caused by them or the vehicle they use, unless an exclusion of liability is hereby agreed. By submitting their entry, participants declare their waiver of claims of any kind for damages arising in connection with the events, namely against the organiser, the marshals, medical personnel, the owners of the race track, sponsors, race services and other persons connected with the organisation of the event and the vicarious agents and assistants of all the aforementioned persons and bodies, except for damages resulting from injury to life, body or health, which are based on an intentional or negligent breach of duty – also by a legal representative or a vicarious agent of the group of persons released from liability – and except for other damages, which are based on an intentional or grossly negligent breach of duty – also by a legal representative or a vicarious agent of the group of persons released from liability against the other participants (drivers, passengers), their assistants, the owners or They waive all claims of any kind for damages arising in connection with the training or the competitions (timed practice, evaluation runs), except for damages arising from injury to life, body or health, which are based on an intentional or negligent breach of duty – also of a legal representative or a vicarious agent of the group of persons released from liability – and except for other damages, which are based on an intentional or grossly negligent breach of duty – also of a legal representative or a vicarious agent of the group of persons released from liability.
The exclusion of liability becomes effective for all parties involved upon submission of the entry. It shall apply to claims on any legal grounds, in particular to claims for damages arising from contractual and non-contractual liability and also to claims in tort. Tacit exclusions of liability remain unaffected by the above exclusion clause.
The participant himself is liable to the organiser for the fact that only he himself drives the vehicle he has registered. Should non-registered drivers use this vehicle on the event track, the participant shall be fully liable for any damage caused by them. In addition, a fine of 500 EUR will be imposed on the participant whose motorbike was used. The fine is due immediately. HM does not accept any liability for the condition of the race track.
Should the event not take place for reasons beyond the control of Hafeneger Motorsport GmbH (e.g. extreme weather conditions, cancellation by the race track operator, failure to reach the minimum number of participants or other important reasons), the participation fee will be credited in full to the participant’s credit account. Cancellation insurance is an exception to this rule. There is no claim for compensation. Further claims are expressly excluded.
The event shall be deemed to have taken place when the paper acceptance desk opens on site (6 p.m. on the day before the event starts). Should “force majeure” occur during the event, the participant has no claim to reimbursement of the entry fee.
If special/inclusive services offered by Hafeneger Motorsport GmbH (e.g. catering, pit areas, races, timekeeping, instruction etc.), which are dependent on deliveries and services of third parties, are not provided, the participant will be reimbursed for payments already made for these services. Further claims are excluded.
The participant has no claim to reimbursement of the entry fee if the driving time is shortened or completely cancelled (e.g. oil, fall, road damage, bad weather, etc.)
Every participant is recommended to take out an accident insurance policy offered by HM. The general and special insurance conditions of accident insurance apply. Participants are given the opportunity to take out accident insurance. The organiser must have received the information on this together with the entry for the event.
With his signature, the participant affirms that he is in possession of a valid international health insurance policy if the event does not take place in his home country.
Should the participant not be in possession of an international health insurance policy, any medical costs incurred are to be borne by the participant.
The participant is responsible for sufficient insurance coverage.
General conditions and regulations during the event
All participants must present themselves at the registration and at the technical inspection before the start of the training, otherwise the confirmation of the start is forfeited. All participants must attend the drivers’ briefing. Non-participation in the drivers’ briefing may also result in a refusal to participate. The drivers’ briefing will be held at the beginning of the event and before the start of the race in the respective classes.
If a participant endangers the life and health of other participants through risky, reckless driving, he will be excluded from the training. If a participant wilfully causes permanent damage to the race track or the facilities of the race track (especially burn-out etc.), he will be held liable for the amount of the damage incurred. This also applies to the insertion of nails, dowels, screws, pegs, etc. into paved surfaces in the paddock and into pit floors and walls.
All participants will be equipped with transponders. The registration of the lap times is only used to check the correct group allocation and not for sporting comparison. For cup and championship events with racing operations, the times of all participants will be published. Non-publication must be explicitly requested by the respective participant at the registration desk.
Transponders will be handed over against the retention of a deposit. Should the transponder be damaged or lost during use, the participant will be charged for the costs incurred (currently 400 EUR gross in case of loss).
If the transponder is taken home by mistake, HM may charge 5 EUR per day until the day of return.
All roadworthy motorbikes are permitted at HM events! The roadworthy condition of the participant vehicles and the clothing of the participants will be checked in a technical inspection before the event. In the event of complaints, participation in the event may be refused. In this case there will be no refund of entry fees.
Mirrors, suitcases and other protruding parts must be removed, sharp edges (e.g. sawn-off frame tubes) are not permitted or must be removed accordingly.
Headlights and indicators should be dismounted, otherwise they must be carefully masked.
Exhaust systems are optional. The driving noise must not exceed the value applicable for the respective race track (92 dB Sachsenring, 100 dB Lausitzring, 98 dB Hockenheim, 98 dB Oschersleben, 101 dB Most, 107 dB Brünn. 105 dB Valencia, 101 dB dynamic Mettet). Exclusion due to exceeding the specified values does not imply a refund of entry fees. Cancellations of events or longer breaks to regulate the noise level are possible if numerous participants violate the noise regulations at the same time.
The choice of tyres is at the discretion of the participants. Their degree of wear and tear must allow safe participation.
The organiser reserves the right to exclude vehicles from the event if they do not comply with the technical regulations. A motorbike without a functioning brake system or with a dismantled silencer will not be admitted to participate in our event. Anyone who crashes must present their vehicle again at the acceptance test.
All participants are obliged to wear additional back protectors, as long as none is built into the suit. Only riders with proper protective clothing will be admitted (undamaged full face helmet (flip-up helmets are NOT allowed), leather suit, leather boots, leather gloves).
Each participant must mark his motorbike with a start number. The start number will be communicated at the latest at the beginning of the event, but usually with the confirmation of registration.
The start numbers must be attached to the front of the vehicle in a clearly visible and legible manner. The height of the start numbers must be at least 12 cm.
Hafeneger Motorsport GmbH has the right to use photos, videos, film recordings etc. produced during the events for its own advertising purposes. Any recordings of participants and their accompanying persons may be published without additional release. Only photographers and video producers authorised by us have the right to photograph/film and commercially exploit these recordings at the events organised by us. Unauthorised sale of goods and services during the event will result in the immediate levying of 500 € stand rental per day.
Entering the safety areas, especially the fall zones, is strictly forbidden for all unauthorised persons. This also includes the pit lane. During races, only the riders’ assistants have access to the pit lane. Smoking is absolutely prohibited in the pit lane! The pit lane is a one-way street! Pit lane may only be used slowly. You may only push against the direction of travel. In the paddock, walking speed applies to all vehicles! Disregard of this rule will result in immediate disqualification or expulsion from the facility. Children under the age of 14 are strictly forbidden to drive in the paddock and pit lane. It is also strictly forbidden for children under the age of 14 to stay in the pit lane. Pets are completely prohibited at most race tracks.
The house rules of the respective race track apply.
Every participant and assistant must follow the instructions of the event management and their representatives. Violations and contraventions of the contents of this announcement, in particular endangerment by reckless driving in the paddock or disregard of the flag signs will lead to disqualification or exclusion from the event.
Exclusive place of jurisdiction for legal disputes is Solingen.
